Terms and Conditions

Platform: ArtFond — a portfolio-builder and online gallery service for artists and galleries, accessible at
https://artfond.me.
Merchant of Record: Paddle.com Market Limited ("Paddle") acts as the authorised reseller and merchant of record for all paid subscriptions and one-time purchases on ArtFond. Paddle handles billing, taxes and refunds in accordance with the
Paddle Buyer Terms and Conditions and the
Paddle Refund Policy.
1. Introduction
These Terms and Conditions ("Terms") govern your use of the ArtFond platform ("Service"). By registering, signing in or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Definitions
- User — an individual or legal entity that has created an account to use ArtFond.
- Content — any material, artwork, image, text, audio, video or other information uploaded, created or displayed by a User on the Service.
- Subscription — a paid plan that gives access to ArtFond features for a recurring billing period.
- Platform — the websites, dashboards and tools that make up the ArtFond Service.
- Third-Party Services — external tools, websites or integrations not owned by ArtFond (for example, payment processors, hosting providers, analytics).
- Paddle — Paddle.com Market Limited, our merchant of record for paid Transactions.
3. Eligibility
The Service is available only to individuals who are at least 18 years old. By registering, you represent and warrant that you meet this requirement. If you are under 18, you must have the consent of a parent or legal guardian in accordance with applicable law (including, where relevant, GDPR Art. 8).
4. Account Registration
- You must provide accurate, current and complete information during registration and keep it up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must notify ArtFond promptly if you become aware of any unauthorised access to your account or any other security breach.
- ArtFond may suspend or terminate any account in the event of fraudulent activity, legal violations or material misuse of the Service.
5. Description of the Service
ArtFond allows Users to create personal websites to display, promote and (where Users enable storefront features) sell their artworks and offer experiences. ArtFond provides the technical infrastructure; sales between Users and their visitors are conducted on Users' own terms, subject to these Terms and applicable law.
6. Subscriptions, Pricing and Payment
- Access to paid features requires an active Subscription, billed monthly or annually depending on the plan you choose.
- Payment is due at the start of each billing cycle.
- Subscriptions renew automatically at the end of each billing period unless cancelled in advance via your account settings.
- All fees are stated in the currency shown at checkout. Applicable taxes (VAT, sales tax) are calculated and collected by Paddle as merchant of record.
- If a payment fails, ArtFond and/or Paddle may retry the charge and, if it cannot be collected, suspend or downgrade your account until the outstanding balance is settled.
7. Refunds and Right of Withdrawal
Because Paddle is the merchant of record for ArtFond purchases, refunds are processed by Paddle. The following rules apply:

EU / EEA / United Kingdom / Switzerland — 14-day right of withdrawal.
If you are a consumer based in the EU, EEA, the United Kingdom or Switzerland, you have a statutory right to withdraw from your first paid Transaction within 14 calendar days from the date of the Transaction and receive a full refund. The right applies to one-off purchases and to the first payment under a Subscription (it does not apply to subsequent renewal payments, except in the limited cases described in the Paddle Refund Policy).

Turkey / Israel — 14 days; South Korea / Brazil / China / Canada — 7 days; Singapore — 5 days.
Consumers in these countries have an unconditional statutory cancellation right counted from the date of the Transaction. To exercise it, you must request a refund within the applicable window.

Outside these jurisdictions / after the statutory window.
Unless required by applicable law, Transactions are non-refundable and non-exchangeable. Paddle may, at its sole discretion, issue a refund if a request is submitted within 14 days of the Transaction date; submitting a request does not guarantee a refund.

Loss of withdrawal right.
The right of withdrawal does not apply to digital content or services where you have given express prior consent for performance to begin during the withdrawal period and have acknowledged that you thereby lose the right of withdrawal.

Effect of a refund.
If a refund is issued, your access to the corresponding paid features will cease. Eligible refunds are processed back to the original payment method within 14 days of approval.

How to request.
To request a refund or exercise a withdrawal right, use the "View receipt" or "Manage subscription" link in your Paddle transaction confirmation email, or visit
paddle.net and select "Request refund". For platform-side questions, you may also contact us at [email protected] and we will help liaise with Paddle.

No refund for misuse.
Refunds will not be issued where there is evidence of fraud, refund abuse or other manipulative behaviour.
Nothing in this section limits your mandatory consumer rights under applicable law. The full and authoritative refund policy is the
Paddle Refund Policy; if there is any inconsistency, the Paddle Refund Policy prevails on matters of billing and refunds.
8. User Content
- You retain ownership of all Content you upload to ArtFond.
- By uploading Content, you grant ArtFond a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce and distribute that Content to the extent necessary to operate the Service, present your personal site to its audience and provide related features (such as search and recommendations on the public marketplace).
- You must hold all rights necessary to upload your Content and confirm that it does not infringe any third-party rights, including copyright, trade-mark, privacy or publicity rights.
- You are solely responsible for the accuracy, authenticity and legality of any Content you upload, including any descriptions, pricing or claims of provenance.
- ArtFond is not liable for the accuracy or authenticity of any artwork uploaded by Users, nor for any potentially misleading representations made by Users to one another or to their visitors.
9. Prohibited Conduct
Users must not:
- violate any applicable law or regulation;
- upload content that is unlawful, defamatory, harassing, hateful, obscene, deceptive or that infringes third-party rights;
- attempt to gain unauthorised access to other users' accounts or to ArtFond systems, networks or data;
- scrape, harvest or otherwise extract data from the Service except as expressly permitted;
- use the Service to send spam or to distribute malware.
10. Termination
- ArtFond may suspend or terminate your account at any time for material breach of these Terms.
- You may cancel your Subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then.
- Termination does not entitle you to a refund of fees already paid, except as required by applicable law or section 7 above.
11. Limitation of Liability
To the maximum extent permitted by applicable law, ArtFond shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, revenue, data or goodwill, arising out of or in connection with your use of the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
12. Data Protection
ArtFond processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and the
ArtFond Privacy Policy. Users have the rights of access, rectification, erasure, restriction and objection under articles 15–22 GDPR, and may exercise them by contacting [email protected].
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Ukraine, without prejudice to any mandatory consumer-protection rules in your country of residence. Disputes will be resolved through good-faith negotiation; if no resolution is reached, disputes shall be submitted to the competent courts of Ukraine, save where applicable law grants you the right to bring proceedings in the courts of your place of residence.
14. Changes to the Terms
- ArtFond may update these Terms from time to time.
- Material changes will be notified by email or via a notice on the Platform at least 14 days before they take effect.
- Continued use of the Service after the effective date of the updated Terms constitutes acceptance of the changes. If you do not agree, you may terminate your account before the changes take effect.
15. Cookies
ArtFond uses cookies and similar technologies to operate the Service, remember user preferences, analyse traffic and improve the product. Users can manage cookie preferences via their browser settings or, where shown, via the cookie banner on the Platform. Details are provided in the Privacy Policy.
16. Intellectual Property
All trademarks, logos, software, design and source code that make up the ArtFond platform are owned by ArtFond or its licensors. You may not copy, reproduce, distribute, modify or create derivative works of any part of the Platform or its design without prior written authorisation, except as expressly permitted by these Terms.
17. Force Majeure
ArtFond will not be liable for any delay or failure to perform caused by events beyond its reasonable control, including (without limitation) natural disasters, war or armed conflict, strikes, internet or hosting-provider outages, or governmental restrictions.
